Verizon Employee Files Federal Charge Against CWA Union Officials for Ignoring Her Rights

Workers refused to abandon job during highly-publicized strike but Verizon continues to illegally seize union dues from her paycheck

Newport News, VA (October 3, 2011) – In the wake of the recent Communications Workers of America (CWA) union-boss instigated strike that grabbed national headlines, a Newport News, Virginia Verizon (NYSE: VZ) worker has filed federal charges against the union and company for violating her rights.

With free legal assistance from National Right to Work Foundation attorneys, Williamsburg resident Monika Cassell filed unfair labor practice charges against the CWA union, its Local 2205, and Verizon for ignoring her right to refrain from paying union dues.

Upset by the CWA union officials' order to strike, and desiring to continue working to provide for their families, Cassell and other Verizon employees resigned from the union and revoked their dues deduction authorizations – a document used by union officials to automatically collect dues from employees' paychecks – while the union did not have a contract at their workplaces.

Under Virginia's popular Right to Work law, no worker can be required to join or pay any money to a union; and under federal labor law, employees can revoke their dues deduction authorizations once a contract terminates.

Worker Speaks Out Against Obama Labor Board Before Congress

In the wake of National Labor Relations Board's (NLRB) move to kill the only protection workers have against card check forced unionism, the U.S. House Committee on Education and the Workforce held a hearing yesterday about the recent onslaught of the NLRB's pro-forced unionism rulings as former-Chairwoman Wilma Liebman's term expired late last month.

Testifying at the hearing was Barbara Ivey, who works at a Portland, Oregon-based IT unit at Kaiser Permanente.

Ivey and 60 of her coworkers were subjected to a Service Employees International Union (SEIU) card check forced unionization campaign (via a neutrality agreement).

Many of Ivey's coworkers reported that they were misled or pressured by SEIU organizers into signing union cards, and didn't even know what they meant.

After the SEIU succeeded in gaining enough cards to claim monopoly bargaining privileges over the workers, the workers were told that if they didn't like it, they could file with the NLRB for a secret-ballot decertification election (per Foundation-won precedent in Dana) to overrule the card check campaign and remove the unwanted union.

After leaning about her rights with the assistance of Foundation staff attorneys, Ivey collected the necessary amount of signatures on a petition for a secret-ballot election.  But then, on August 26, 2011, the Obama NLRB overruled the Dana precedent in Lamons Gasket and the election was summarily cancelled.

Now, the employees in the Kaiser IT department are stuck with the SEIU for anywhere from one to four years before they will even have a chance to force a secret-ballot vote (and getting a decertification vote is a major uphill battle for employees who will have campaign against an entrenched union with full-time paid professional organizers).

Ohio Teachers File Class-Action to Halt Compulsory Union Dues for Political Activism

Union bosses illegally force Ohio’s teachers to pay for electioneering

Columbus, Ohio (August 5, 2011) – With free legal assistance from the National Right to Work Foundation, 15 public school teachers across the state filed a federal class-action lawsuit against the Ohio Education Association (OEA) and nine of its regional affiliates for violating their rights.

The group filed the class-action suit after the OEA union unlawfully overcharged the teachers – who have refrained from full-dues-paying union membership – for union "fees" taken from their paychecks, charging them for costs supporting the union’s political activism and electioneering. Per Foundation-won U.S. Supreme Court precedent in Abood v. Detroit Board of Education, under the First Amendment to the U.S. Constitution nonmember teachers cannot be forced to pay dues or fees for union boss politics and other non-bargaining activities.

Additionally, the OEA union's regional affiliates are collecting compulsory fees from non-members without providing the kind of independently-audited financial statements required by law.

Teamster Union Bosses Hit with Federal Charges for Having Coca-Cola Worker Illegally Fired

Incident shows Pennsylvania’s workers desperately need Right to Work protections

Houston, PA (July 5, 2011) – With free legal assistance from the National Right to Work Foundation, a former Coca-Cola employee has filed federal charges against a local Teamster union and the company for discrimination and illegally firing him from his job.

Keith Smiesko of Saxonburg filed the federal charges with the National Labor Relations Board (NLRB) regional office in Pittsburgh on Thursday.

Earlier this year, Teamster Local 585 union officials ordered Smiesko – who had refrained from full union membership and dues payments – to immediately pay full union dues for the previous three years along with additional union initiation fees without ever notifying him that he was being charged for their so-called "representation." Union officials illegally threatened Smiesko with job termination if he did not pay.

Smiesko refused, exercising his rights under the Foundation-won Supreme Court precedent in Communication Workers v. Beck, which allows workers to refrain from full-dues-paying union membership. Teamster Local 585 union officials then demanded that Coca-Cola fire Smiesko and Coca-Cola complied with the union bosses' command.

Teacher Files Brief in Wisconsin Government Unionism Reform Battle in Federal Court

Public-sector union bosses file desperate lawsuit seeking to protect forced dues stranglehold over Wisconsin’s public workers and taxpayers

Madison, WI (June 29, 2011) – With free legal assistance from the National Right to Work Foundation and the Wisconsin Institute for Law & Liberty, a Kenosha teacher affected by Wisconsin’s recent public-sector unionism reforms has filed an amicus curiae brief in federal court.

Kristi Lacroix, who has been a teacher for 13 years and is an English teacher at the LakeView Technology Academy in Pleasant Prairie, filed the brief Monday in favor of the reforms which sharply limited government union officials’ monopoly bargaining power over public workers and taxpayers.

Earlier this month, the Wisconsin Supreme Court upheld Governor Scott Walker’s government-sector monopoly bargaining reform bill, which protects the Right to Work for most government employees and bans automatic forced-union-dues seizures from public employees’ paychecks.

In response, union lawyers filed a new lawsuit in federal court seeking to overturn the bill, claiming that Freedom of Association – the right of American citizens to voluntarily come together to express their opinions and petition the government – gives union bosses forced-dues and monopoly bargaining powers.

Foundation staff attorneys have won at the United States Supreme Court numerous times on this very issue, winning precedents that support the constitutionality of Wisconsin’s government-sector monopoly bargaining reform bill.

South Carolina Boeing Employees Move to Intervene in Obama Labor Board’s Assault on Right to Work Laws

National Right to Work Foundation attorneys helping workers and former Machinist union president challenge attempt to send jobs to Washington

Washington, DC (June 2, 2011) – With free legal assistance from the National Right to Work Foundation, a group of Charleston-area Boeing Company employees are asking to intervene in the National Labor Relations Board's (NLRB) unprecedented case targeting Boeing (NYSE: BA) for locating production in South Carolina in part due to its popular Right to Work law. That law ensures that union dues and membership are strictly voluntary.

The NLRB's complaint, if successful, would eliminate over 1,000 existing jobs in South Carolina, not to mention several thousand more jobs that would be created once the Boeing plant reaches full production capacity. Further, the case could set a dangerous precedent that allows union bosses to dictate where job providers locate their facilities.

In 2009, Boeing, after experiencing repeated International Association of Machinists (IAM) union boss-instigated strikes in the forced unionism state of Washington, decided to locate a new production line for the 787 Dreamliner to South Carolina, partly because South Carolina is a Right to Work state. IAM union bosses in state of Washington cried foul and filed unfair labor practice charges against Boeing.

The NLRB's Acting General Counsel Lafe Solomon sided with IAM union bosses and decided to prosecute Boeing in late April. Ironically, workers in Boeing's South Carolina plant booted IAM union bosses from their plant to attract the Dreamliner production, as the workers did not want union bosses interfering with their job prospects.

Boeing employees Dennis Murray, who led the effort to remove the union from the Charleston plant; Cynthia Ramaker, the former president with the local union which was removed from the plant; and Meredith Going filed their motion to intervene in the case with the NLRB regional office in Seattle, where the NLRB's case is pending.

Bank Employee Wins Settlement After AFSCME Union Bosses Illegally Seized Forced Dues for Politics

Wisconsin needs Right to Work law to protect workers from forced unionism abuses

Milwaukee, WI (May 31, 2011) – A U.S. Bank customer service and support employee reached a settlement with local union officials last week after union officials illegally attempted to force him and his colleagues into full-dues-paying union membership.

Peter Quinones of Milwaukee filed unfair labor practice charges with the National Labor Relations Board (NLRB) against American Federation of State, County, and Municipal Employees (AFSCME) Local 777 union officials in March with free legal aid from the National Right to Work Foundation.

After AFSCME Local 777 union bosses were granted monopoly bargaining privileges over approximately 300 U.S. Bank employees, Quinones sent a letter to union officials stating that he was exercising his right under National Right to Work Foundation-won Supreme Court precedent in Communication Workers v. Beck to refrain from full-dues-paying union membership.

Union Member Seeks to Block Obama Labor Department’s Efforts to Roll Back Union Disclosure Rules

Department guts disclosure rule that has exposed numerous corrupt union boss schemes, let rank-and-file members know how dues are spent

Washington, DC (May 23, 2011) – With free legal aid from the National Right to Work Legal Defense Foundation, a Maryland county government employee is asking a federal court to stop the Obama Administration from allowing union bosses to conceal lavish and corrupt union expenditures from workers.

Chris Mosquera, a member of a Municipal County Government Employee Local of the United Food and Commercial Worker (UFCW) union, filed the lawsuit against Secretary of Labor Hilda Solis in the U.S. District Court for the District of Columbia for rescinding a union boss disclosure rule which would make it less difficult for workers to hold union officials accountable.

Unions covered by the Labor Management Reporting and Disclosure Act (LMRDA) with total annual receipts of $250,000 or more are currently required to submit annual financial statements to the U.S. Department of Labor. LM-2 forms are the public disclosure documents for these larger unions and are available online on the U.S. Department of Labor’s (DOL) website.

These forms have helped workers and citizen activists expose many unscrupulous union boss schemes, including lavish benefits to high-ranking union officials and loyalists, superfluous spending on union boss transportation (including private jets), and shady political spending (such as the Service Employees International Union bosses’ links to the disgraced political organization ACORN).

Study: Right to Work Law Would Have Significantly Helped Indiana Workers, Families During Past Four Decades

As Indiana's state legislators discuss the merits of passing Right to Work protections for Hoosier workers, a group of scholars released a study last week confirming (pdf) workers and their families in Right to Work states benefit from workplace freedom in a very tangible way. From a press release announcing their findings:

Improving the per-capita income of Indiana workers and creating more job opportunities for Hoosiers would be among the major benefits of Indiana becoming the 23rd state to pass a right-to-work (RTW) law, according to research released today by the Indiana Chamber of Commerce. In addition, statewide voter polling results show Hoosiers favoring adoption of RTW by a 3-to-1 margin.

Dr. Richard Vedder, an Ohio University economist, and his colleagues report in the study (Right-to-Work and Indiana's Economic Future) that if Indiana had adopted RTW in 1977, per-capita income would have been $2,925 higher -- or $11,700 higher for a family of four - by 2008. Looking forward (projecting the same growth rate in the next 10 years after adjusting for inflation), passage of a RTW law in 2011 would raise per capita income by $968 -- or $3,872 for a family of four -- by 2021.

The scholars conclude that a Right to Work law would benefit workers with greater job growth and real personal income. These results mirror the thorough research conducted by the National Institute for Labor Relations Research (NILRR), which has found that families benefit from Right to Work laws with more job availability and higher expendable income. No wonder workers and their families are seeking greater workplace freedom, leaving forced unionism states in droves.

Union Bosses, School District Face Federal Suit for Illegal Forced Union Dues Scheme

School employees challenge unconstitutional union dues confiscation

Cincinnati, OH (January 21, 2011) – A group of Cincinnati Public Schools employees today filed a federal lawsuit against a local union and the city school district for illegally confiscating union dues from their paychecks in violation of their constitutional rights.

National Right to Work Foundation attorneys, providing the employees with free legal aid, filed the suit in the United States District Court for the Southern District of Ohio.

The school district carpentry shop employees, who have exercised their right to refrain from formal union membership with the Greater Cincinnati Building & Construction Trades Council union (GCBCTC) and its affiliates, ask the federal court to protect their Right to Work Foundation-won rights upheld by the U.S. Supreme Court in Chicago Teachers Union v. Hudson.
